Please read each provision of this Agreement carefully before using CityBike services. By accessing or using the CityBike website, mobile application, bicycles, e-bikes, or related services, you agree to be bound by these Terms and Conditions. If you do not agree with these Terms, please do not use CityBike services.

The materials contained within the CityBike website and mobile application are protected by applicable copyright, trademark, and intellectual property laws. You may not copy, reproduce, distribute, modify, reverse engineer, or create derivative works from any part of the CityBike platform, software, branding, or related services without prior written permission from CityBike.

CityBike is committed to providing safe, reliable, and efficient shared mobility services. We reserve the right to modify, improve, suspend, or discontinue any part of the services, pricing structure, operational areas, subscription plans, or platform functionality at any time.

This User Agreement and Terms of Use (“Agreement”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and CityBike (“CityBike”, “we”, “us”, or “our”).

Definitions

“Agreement”

Means these Terms and Conditions.

“CityBike”

Refers to CityBike.lk, its operators, affiliates, partners, employees, contractors, and authorized representatives.

“Vehicle”

Means any bicycle, electric bicycle (e-bike), scooter, or other mobility device provided by CityBike.

“Services”

Means the CityBike website, mobile application, vehicles, subscriptions, parking systems, payment systems, customer support services, and all related services.

“Subscription”

Means any ride pass, membership, promotional package, prepaid plan, or rental package offered through CityBike.

“Operational Area”

Means the geographical areas designated by CityBike where vehicles may be operated, parked, or returned.

“App”

Means the CityBike mobile application or software platform through which users access CityBike services.

“Website”

Means the official CityBike website located at CityBike.lk

1. General Terms

1.1 Agreement and Responsibility

You are the sole authorized user of the CityBike services under your account and are fully responsible for all activities conducted through your account.

You agree not to permit any unauthorized person to use a CityBike vehicle rented through your account.

You are fully responsible for the proper and lawful use of CityBike property during the rental period.

1.2 Eligibility and Age Requirement

Users must meet the minimum legal age required under applicable local laws to operate bicycles or e-bikes.

By accepting these Terms, you confirm that you are legally permitted to use CityBike services in the applicable jurisdiction.

1.3 Proper Use of CityBike Property

You agree to use CityBike services, vehicles, software, and related property respectfully, responsibly, and only for their intended purpose.

Users must not:

  • Damage, vandalize, misuse, or tamper with vehicles
  • Modify or attempt to repair vehicles without authorization
  • Interfere with GPS, battery, locking, or tracking systems
  • Use vehicles for unlawful activities
  • Use vehicles under the influence of alcohol or drugs
  • Use vehicles in a reckless or dangerous manner

CityBike reserves the right to suspend or terminate accounts involved in misuse or abuse of the services.

2. Vehicle Rental and Usage

2.1 Safety Responsibility

Before starting each ride, you are responsible for ensuring that the vehicle is safe to operate.

You must inspect:

  • Brakes
  • Tires
  • Steering
  • Lights and reflectors
  • Battery level
  • General physical condition of the vehicle

You must not use any vehicle that appears damaged, unsafe, or defective.

If you detect any defect, malfunction, or safety issue, you must immediately report it through the app or customer support.

2.2 Safe Riding Requirements

Users are responsible for operating vehicles safely and in accordance with all applicable traffic laws and regulations.

You must consider:

  • Traffic conditions
  • Pedestrian safety
  • Weather conditions
  • Road surface conditions
  • Battery range
  • Your riding ability

Helmet use is strongly recommended.

Only one rider is permitted per vehicle unless otherwise authorized by CityBike.

2.3 Restricted Areas

Vehicles may only be used within designated operational areas shown in the app.

Users must not ride or park vehicles in:

  • Restricted government areas
  • Protected archaeological zones
  • Sacred or religious sites where prohibited
  • High-risk or unsafe areas
  • Private property without authorization

CityBike reserves the right to apply additional charges for vehicle recovery from restricted or unauthorized areas.

2.4 Battery and Charging Safety

Users must not:

  • Open or tamper with batteries
  • Attempt unauthorized charging
  • Expose batteries to fire, water, or hazardous conditions
  • Use damaged charging equipment

Any battery-related damage caused by misuse or negligence may result in repair or replacement charges.

2.5 Availability of Services

Vehicle availability may vary depending on:

  • Weather conditions
  • Maintenance requirements
  • Charging schedules
  • Operational limitations
  • Government regulations
  • Force majeure events

CityBike does not guarantee uninterrupted access to vehicles or services at all times.

3. Parking Rules

3.1 Proper Parking

Vehicles must be parked responsibly and legally at the end of each ride.

Users must not block:

  • Sidewalks
  • Roads
  • Building entrances
  • Emergency exits
  • Accessibility paths
  • Hotel access points

Where applicable, vehicles should be parked in:

  • Bicycle racks
  • Designated parking areas
  • Approved parking zones shown in the app

Users may be required to upload a clear parking photo before ending the ride.

3.2 Improper Parking and Recovery Fees

If a vehicle is improperly parked, abandoned, damaged, confiscated, or requires repositioning or recovery, CityBike reserves the right to charge reasonable recovery, handling, or penalty fees.

Additional charges may apply if municipalities, hotels, private properties, or authorities impose fines or removal charges on CityBike due to user misconduct.

4. Payments and Charges

4.1 Ride Charges

Users agree to pay all applicable:

  • Ride fees
  • Subscription fees
  • Reservation fees
  • Parking penalties
  • Recovery charges
  • Damage charges
  • Applicable taxes and government fees

All prices are displayed within the app or website and may be updated periodically.

4.2 Payment Authorization

By using CityBike services, you authorize CityBike to charge your selected payment method for all applicable charges associated with your account.

Failure to maintain a valid payment method may result in suspension of services.

4.3 Refund Policy

Refund requests are reviewed on a case-by-case basis.

Where permitted by law, CityBike reserves the right to deduct payment processing fees, administrative charges, or third-party transaction costs from refunded amounts.

5. Damage, Theft, and Accidents

5.1 Responsibility During Rental

You are responsible for the vehicle from the moment the rental begins until it is properly returned and locked within the approved operational area.

You agree to immediately report:

  • Accidents
  • Damage
  • Theft
  • Loss
  • Unsafe conditions
  • Injuries involving the vehicle

Users may be held financially responsible for damage, theft, vandalism, negligence, or misuse occurring during the rental period.

5.2 Accident Reporting

In the event of an accident involving injury, property damage, or third parties, users must:

  • Notify local authorities where required
  • Seek medical assistance if necessary
  • Inform CityBike immediately through customer support

6. GPS Tracking and Technology

CityBike vehicles may contain GPS tracking systems, IoT devices, sensors, and remote control technology for operational, security, maintenance, and safety purposes.

By using the services, you consent to the collection and use of location and operational data in accordance with the Privacy Policy.

CityBike reserves the right to remotely disable or restrict vehicles where necessary for safety, recovery, maintenance, legal compliance, or operational reasons.

7. Privacy Policy

CityBike collects, stores, and processes personal information in accordance with the CityBike Privacy Policy.

By using the services, you consent to the collection and processing of your information for:

  • Account management
  • Payments
  • Security monitoring
  • Fraud prevention
  • Customer support
  • Legal compliance
  • Operational analytics

8. Limitation of Liability

Use of CityBike services is at your own risk.

To the maximum extent permitted by law, CityBike shall not be liable for:

  • Indirect or consequential damages
  • Personal injury resulting from improper use
  • Loss of personal belongings
  • Service interruptions
  • Battery depletion
  • Weather-related incidents
  • Third-party actions
  • Traffic violations committed by users

Nothing in this Agreement excludes liability where such exclusion is prohibited by applicable law.

9. Suspension and Termination

CityBike reserves the right to suspend, restrict, or terminate user accounts at any time for:

  • Violation of these Terms
  • Fraudulent activity
  • Unsafe riding behavior
  • Payment failure
  • Misuse of services
  • Damage to CityBike property

10. Updates to This Agreement

CityBike reserves the right to update or modify this Agreement at any time without prior notice.

Updated Terms become effective immediately upon publication on the website or app.

Continued use of CityBike services after updates constitutes acceptance of the revised Terms.

11. Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws applicable in the country or region where CityBike operates.

Any disputes arising from the use of CityBike services shall be subject to the jurisdiction of the competent local courts.
